Refund Policy/Terms of Service
REFUND POLICY:
All sales are final once a Group Break has filled and/or begun.
Refunds may be requested only for orders associated with Group Breaks that have not yet filled. Once a Group Break has filled or started, no refunds, returns, or exchanges will be permitted under any circumstances.
Eligible refunds may be issued either:
To the original method of payment, or
As store credit applied to your RhodyBreakers account.
Refunds issued to the original method of payment are subject to a 5% payment processing and administrative fee. This fee is waived for refunds issued as store credit.
All refund requests must be submitted by email to support@rhodycards.com and must include the applicable order number(s). Refund requests that do not include order numbers may be delayed or denied.
TERMS OF SERVICE:
These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Baseball Cards of RI Inc., doing business as RhodyBreakers (“RhodyBreakers,” “we,” “us,” or “our”), concerning your access to and use of https://www.rhodycards.com and any related media, mobile website, or applications (collectively, the “Site”).
By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree to all of these Terms, you are expressly prohibited from using the Site and must discontinue use immediately.
Modifications to Terms
We reserve the right, in our sole discretion, to modify or replace these Terms of Use at any time. Updates will be reflected by revising the “Last Updated” date. Your continued use of the Site after such changes constitutes acceptance of the revised Terms.
Group Breaks – Random Distribution & No Guarantee
Participation in group breaks involves the random distribution of trading cards. RhodyBreakers makes no guarantee, express or implied, that any participant will receive cards of a particular player, team, brand, quantity, or secondary market value.
By purchasing a break spot, you acknowledge and agree that:
Hits, value, or specific cards are not guaranteed
You may receive cards of minimal or no monetary value
Lack of hits or perceived value does not constitute grounds for a refund, chargeback, or dispute
Once a Group Break has filled or started, all sales are final regardless of outcome.
Lawful Use
The Site is not intended for use in any jurisdiction where such use would violate applicable laws or regulations. Users accessing the Site from outside the United States do so at their own risk and are responsible for compliance with local laws.
The Site is not designed to comply with industry-specific regulations such as HIPAA, FISMA, or GLBA. You may not use this Site in any manner that would subject RhodyBreakers to such regulatory requirements.
Governing Law and Venue
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Rhode Island, without regard to conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located within the State of Rhode Island.
Shipping, Handling & Delivery
All cards are shipped to the address provided by the customer at checkout. It is the customer’s responsibility to ensure that all shipping information is accurate and up to date prior to shipment.
RhodyBreakers is not responsible for packages that are lost, delayed, damaged, or misdelivered by the carrier once the shipment has been transferred to the carrier. Tracking information will be provided when available.
If a customer wishes to obtain shipping insurance, they must contact RhodyBreakers directly within 24 hours of the break’s completion. Any shipping insurance requested will be arranged at the customer’s expense. If shipping insurance is not requested within this timeframe, RhodyBreakers shall not be liable for lost, damaged, or misdelivered shipments beyond any amount recoverable from the carrier, if applicable.
In the event a package is marked as “delivered” by the carrier, RhodyBreakers is not responsible for theft, loss, or damage occurring after delivery.
All shipping sales are final. Shipping charges are non-refundable once an order has been shipped.
Live Breaks & Livestream Disclaimer
Group Breaks are typically conducted live via video streaming platforms. By participating in a Group Break, you acknowledge and agree that livestreams may be subject to technical issues, including but not limited to video or audio interruptions, buffering, stream outages, recording failures, or platform-related errors.
RhodyBreakers is not responsible for livestream interruptions or technical difficulties that occur during a break. In the event of a livestream disruption, breaks will continue once reasonably possible, and the recorded results of the break shall govern.
All cards are opened, sorted, and assigned based on the actual cards pulled, regardless of livestream quality, interruptions, or viewer access at the time of the break. Lack of ability to view a livestream does not constitute grounds for a refund, dispute, or chargeback.
Break results, checklists, and card assignments are final once the break has been completed.
